Robert contacted Pryers  7 years after he had an osteoarticular transfer system (OATS) procedure on his knee in 2006 following a skiing accident. The knee had ongoing symptoms and in 2013 he was told he would need another OATS procedure. He didn’t understand why it would need to be done again.

Pryers contacted a medical expert who said that Robert had not needed the OATS procedure in 2006,  as the lesion on the knee was an old lesion, and this would not have caused issues until later in Robert’s life. The medical expert argued that the skiing accident had probably only required conservative measures.

Furthermore, when the OATS  procedure was carried out it was done to a poor standard. The graph site was wrong and this has caused ongoing issues. Robert will now require surgery on his knee in the future.

The Defendant initially denied the claim, however then made a small admission that the graft site was wrong. They claimed that this only caused 5 to 10% of Robert’s problems and the rest was due to the old lesion he had on the knee. Our medical expert disagreed.

Before the claim proceeded to court, the Defendant made an offer of £107,500 plus costs, which Robert very happily accepted.
