What is a PI trust?

A personal injury trust is a legal arrangement that looks after the compensation payout that an individual has been given after a personal injury. The aim of a PI trust is to ring-fence the awarded compensation to meet the needs of the person who recieved it. The trust is set up to ensure that the beneficiary, the person who received the compensation, remains entitled to any state benefits, even if they are means-tested. This allows the beneficiary to use the PI compensation for their care and support without risking their eligibility for other key benefits like Universal Credit.

How does a PI trust work?

The compensation awarded is placed into a trust account which has terms agreed on how the money can be spent. The account is managed by trustees, and the beneficiary can then use the money in the account as long as they follow the terms that were agreed when the trust was set up. Every transaction made with money from the trust has to be authorised by each trustee, so the beneficiaries are protected from potential financial abuse or mismanagement of their money. This makes PI trusts useful for the elderly, vulnerable and children as well as people who have suffered a serious injury but retain their capacity.
