DA v Dr AP

£50,000 Settlement

This was a periodontal claim that Pryers Solicitors settled

The client attended for dental treatment under the care of the two Defendants in Sheffield between 1980 and 2010.

With expert evidence, we established that the Defendants had failed to provide even basic periodontal examinations and failed to take routine radiographs during nearly a thirty year period. Our expert considered the Defendant’s failed to diagnose the client’s periodontitis and as a result the client suffered the loss of six teeth (UR7, UL7, LR4, LL6, LL7 and UR6).

We obtained a causation report from a Specialist in Periodontics based in Manchester and he considered that if the client’s periodontal disease had been diagnosed in its early stages its progress could have been arrested, his periodontal bone loss would have been avoided with appropriate care and the client would have been expected to keep all of his teeth which were present in 1980 for the rest of his life.

The client would require extensive restorative treatment the client would require, including provision of partial upper and lower acrylic dentures, bilateral maxillary sinus lift surgery and placement of a fully supported maxillary prosthesis as an interim measure. After several months of healing the client would then require placement of two implants in the maxilla and six implants in the mandible, with bone grafting in the anterior maxilla and mandible including sinus augmentation in the posterior areas.

After extensive negotiations, we received an offer of £50,000 from Dental Protection and the client advised he wanted to accept the offer because he wanted to draw a line under the case and because this would provide him with more than sufficient compensation for him to undergo the restorative treatment required.
