Mrs P worked as a Detention Custody Manager for the Defendant prison. The Defendant’s process was to medically screen all residents when they first arrived at the centre. On 10th June 2015, Mrs P was on duty with another Custody Manager. A resident arrived and had to be restrained. During the restraint, the resident bit Mrs P on the left hand.

It later transpired that, contrary to the process in place, the resident had not been medically screened. The Defendant, therefore, could not confirm whether the resident was HIV positive and as such, whether Mrs P was at risk of contracting the virus.

Mrs P attended hospital and underwent a procedure whereby the damaged tissue was removed and the wound was cleaned out and then closed. She was also given a course of medication to prevent contraction of HIV or Hepatitis.

The claim was submitted on the portal under employer’s liability. The Defendant admitted liability so we proceeded to obtain evidence in relation to Mrs P’s injuries.

Opinion was sought from a Consultant Plastic Surgeon and a Consultant Psychiatrist as to the physical and psychological injuries suffered by Mrs P. Her injuries included permanent scarring to her hand, anxiety, features of PTSD and a depressive disorder of mild severity.

Negotiations were entered into and damages in the sum of £12,000 were accepted on behalf of Mrs P. The client was very happy with the outcome.
