Our client, Emma, worked in a pub and was unfortunately assaulted by a customer. She sustained various injuries mainly to her neck and her shoulder. She initially tried to claim through the Criminal Injuries Compensation Authority (CICA), but her initial application failed because she had failed to prove her injuries fell within the tariff scheme.
Emma appealed the decision but her appeal failed. After this, Emma approached Pryers, and we agreed to take the matter to Tribunal.
Pryers helped Emma write a persuasive letter to the CICA ahead of the hearing in order to narrow the issues and met with Emma a fortnight before the hearing to prepare her for the keys submissions she ought to make. This allowed Emma keep the costs to a minimum as she did not have to pay for counsel or Pryers to attend Tribunal.
In January 2019 this review decision was heard before the Tribunal. Tribunal concluded that she did have a medically recognised condition which was moderately disabling but not permanent. Emma was awarded £6200.
