£26,000 Settlement
Mrs D, who was 30 years old at the time, complained to Pryers Solicitors regarding a failure to manage and follow up an ovarian cyst over a 3-year period. As a result, the cyst became significantly larger, and Mrs D required a total hysterectomy, as well as removal of both ovaries and fallopian tubes, which caused her to undergo premature menopause.
Pryers Solicitors investigated her complaints with the assistance of a gynaecological oncologist, who was of the view that, during her second pregnancy in 2008, the cyst was identified, but was never followed up. The expert confirmed that had Mrs D been properly followed up, although she would have required removal of the cyst initially, she would have avoided the additional further surgery, and would have avoided the acceleration of menopause.
On examination by an expert Consultant Psychiatrist, it was also determined that Mrs D had suffered a psychiatric injury, as a result of having to undergo such surgery, and an accelerated menopause so early in life.
Allegations were put to the Defendant, who accepted that they breached the duty of care owed to Mrs D, and accepted that some, but not all, of the outcome flowed from this negligence. The Defendant argued that Mrs D would still have required further surgery, albeit later in life.
Following extensive negotiations with the Defendant, Mrs D’s case settled for £26,000.
