Negligence Leads To The Death Of Young Woman

Ms P contacted Pryers Solicitors to investigate a potential claim regarding the death of her daughter Rebecca in October 2013. Rebecca had previously suffered with anxiety and alcohol abuse, and was admitted to hospital in 2013 after taking a suspected overdose.

Unfortunately, there were failures in adequately monitoring Rebecca, and protecting her airway, and she went on to develop pulmonary aspiration, aspiration pneumonitis and infection. This then developed into Acute Respiratory Distress Syndrome (ARDS) and she had to be ventilated with intense treatment for 55 days. Sadly, Rebecca did not recover and she passed away.

Supportive expert evidence was obtained from an expert in Emergency Medicine and an expert Intensivist. Allegations were sent to the Defendant Trust, alleging failures in monitoring Rebecca’s neurological signs and protecting her airways, which caused her to develop significant problems and infection, and ultimately led to her death.

The Trust accepted that there was a failure to take steps to protect Rebecca’s airway, that this caused her to develop pulmonary aspiration, aspiration pneumonitis and then ARDS, and subsequently caused her death.

Negotiations began with the Defendant and the case settled for £13,000. Ms P was pleased to obtain some closure following the conclusion of the case and to try and move on.
