This was a case about the failure to treat periodontal disease.
WP was a patient at a Dental Surgery in Essex from 2002 to 2008. In 2009, when the Claimant attended a new dentist she was diagnosed with advanced periodontal disease. The first Dental Surgery denied any negligence.
We obtained reports from an expert Dentist, which was supportive, but he indicated an aggressive treatment plan to replace all affected teeth with dental implants.
The claim was submitted to the Dentist’s representatives. Their letter of response alleged that the Claimant was more susceptible to the detrimental effects of plaque which would result in the progression of periodontal disease and tooth loss even with appropriate profession treatment and home care. They allege that the substantial bone loss suffered by the Claimant is evidence that she was susceptible and earlier referral for aggressive treatment would not have changed the outcome.
After initially offering £8000, the Defendant settled the case for £38,500.
