Increase in Gynaecology Claims due to Vaginal Mesh Claims

NHS Resolution’s annual reports and accounts reveals a significant increase in gynaecology claims. They have attributed this to vaginal mesh claims.

Significant Increase in Gynaecology Claims

In 2019/20 NHS Resolution report to have received 11,682 medical negligence claims and incidents. This represents an increase of 998 (9.35%) compared to 2018/19.

401 of the increase relates to the new Clinical Negligence Scheme for General Practice.

Of the 404 that can be compared to 2018/19, over half of these (208) were gynaecology claims. That therefore represents a 145% increase on 2018/19.

Vaginal Mesh Claims

NHS resolution attribute the sudden increase to ‘vaginal mesh related incidents’. They describe these claims as involving the insertion of:

  • Tension-free vaginal tape;
  • Transobturator tape;
  • Transvaginal tension free vaginal tape-obturator; or
  • Vaginal mesh (vaginal tape or mesh)

To treat symptoms of stress urinary incontinence (SUI) or pelvic organ prolapse (POP).

Most of the claims are for:

  • Not providing adequate warning about the risks of the procedure
  • Not offering alternative treatment; and/or
  • Because the standard of surgery is negligent.

Problems Caused by Vaginal Mesh

Vaginal mesh is used by surgeons to reinforce the vaginal wall, urethra or bladder neck. It’s a relatively common procedure, with about 15,000 women undergoing it each year, in the UK. However, for some of those it has been responsible for causing excruciating pain.

The consequences have been so severe for some that they are having to contemplate the complicated process of having it removed.
